Terms of Use
The conditions on which NPL Australia makes this website and its associated technical documentation available. These terms govern your access to and use of nplaustralia.com.au and any subdomains, including the Partner Portal. They do not displace the separate written contract that governs any actual supply, custom-synthesis, or contract-manufacturing engagement.
What this site is for: giving you general information about NPL's products and capabilities, taking enquiries, and, for approved partners, controlled access to the Partner Portal. It is not a public ordering channel and nothing here is an offer to supply.
What you mustn't do: reverse-engineer, scrape, attempt unauthorised access, or treat published technical material as instructions for synthesising or handling energetic materials. Real engagements happen under signed contract, not via the website.
Who governs this: Australian law, Queensland courts. If you're a consumer, your statutory rights under the Australian Consumer Law are unaffected. Questions: [email protected].
Acceptance & scope
These Terms of Use ("Terms") form a binding agreement between you and National Propellant Laboratory Pty Ltd (ABN 20 663 264 775), trading as NPL Australia ("NPL", "we", "us", "our"). By accessing or using nplaustralia.com.au, any subdomain, or the Partner Portal (collectively, the "Site"), you agree to be bound by these Terms.
If you do not agree, do not access or use the Site. Continued use of the Site after a revision is published (see § 14) constitutes acceptance of the revised Terms.
These Terms operate alongside our Privacy Policy and any export-control or partner-portal access conditions notified to you. They do not replace, amend, or otherwise affect the terms of any signed supply, synthesis, or manufacturing contract between NPL and a customer or prime, those contracts prevail in the event of inconsistency.

Eligibility & account access
The public Site is available for general informational use by adults. The Partner Portal is available only to Authorised Users acting on behalf of an organisation that has been onboarded under NPL's partner-qualification process.
If you are issued Partner Portal credentials, you agree that:
- You will keep your username, password, and authentication factors confidential, and will not share them with any other person.
- You are responsible for all activity under your credentials, and will notify NPL immediately at [email protected] if you suspect compromise.
- You will use the Portal solely for the purpose for which access was granted, and only while you remain authorised by your organisation.
- NPL may suspend, revoke, or audit access at any time without notice where required for security or compliance.
Permitted use
Subject to these Terms, NPL grants you a limited, revocable, non-exclusive, non-transferable licence to:
- Access the public Site for the purpose of evaluating NPL's capabilities and initiating a commercial enquiry.
- View, and print or save individual pages, datasheets, and Content for your internal business or research reference.
- If you are an Authorised User, access and use Partner Portal Content for the engagement scope notified to you.
All other rights are reserved by NPL or its licensors. No other use is permitted without our prior written consent.
Prohibited use
You must not, and must not permit any other person to:
- Access, or attempt to access, any non-public area of the Site without authorisation, including by credential-stuffing, brute-force, or session-hijack techniques.
- Scrape, crawl, harvest, mirror, or systematically extract Content other than via NPL-published interfaces and within published rate limits.
- Reverse-engineer, decompile, or attempt to derive source from any software made available through the Site, except to the extent such restriction is prohibited by applicable law.
- Use Content as instructions, recipes, or operating parameters for the synthesis, formulation, handling, or detonation of energetic materials. NPL Content is descriptive of products and capabilities, not a manual for unsupervised replication.
- Submit false, misleading, or deceptive information through any form on the Site, including misrepresenting your identity, employer, or end-use.
- Upload or transmit malware, exploits, or any code intended to disrupt, damage, or surveil the Site or its users.
- Use the Site in a way that breaches Australian law, applicable foreign law, or any defence-trade or export-control regime.
- Frame, mirror, or republish Content on a third-party site, or remove any proprietary, classification, or revision notice from Content.
Breach of this clause may result in immediate suspension of access and referral to law-enforcement or applicable regulators.
No offer of supply
The Site is an informational and engagement channel. Nothing on the Site, including product pages, datasheets, capability descriptions, indicative specifications, or pricing references, constitutes an offer to supply, a commitment to manufacture, or a representation that any product is currently available.
Supply is provided only under a signed written contract executed by an authorised NPL representative, following completion of customer-qualification, end-use review, and any applicable export-control determination. Any quote issued by NPL is subject to written contract and remains revocable until accepted in writing by NPL.
Intellectual property
All Content, including the Site's design, layout, source code, copy, technical descriptions, datasheets, diagrams, and the NPL name, mark, and logo, is owned by NPL or its licensors and is protected by Australian and international copyright, trade-mark, and confidential-information law.
The licence granted in § 4 does not transfer ownership of any Content. You acquire no right, title, or interest in any NPL intellectual property by virtue of accessing the Site.
Feedback
If you provide NPL with suggestions, comments, or feedback about the Site or NPL's products ("Feedback"), you grant NPL a perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce, modify, and incorporate that Feedback for any purpose, without obligation or attribution.
Export & defence controls
The Site and its Content may include, or be subject to, Defence-Controlled Material. By accessing the Site you acknowledge and agree that:
- You will comply with the Defence Trade Controls Act 2012 (Cth), the Defence and Strategic Goods List, the Customs Act 1901 (Cth), and any applicable foreign export-control regime.
- You will not access, view, or download Content from a jurisdiction, or on behalf of a person or entity, that is the subject of Australian sanctions or a UN Security Council sanctions regime.
- You will not transfer, retransmit, or onward-disclose Content to a foreign person or foreign jurisdiction except where you hold the necessary permit or exemption.
NPL may at any time decline access, refuse to issue a quote, or terminate an engagement where, in its reasonable judgement, doing so is necessary to comply with export-control, sanctions, or sovereign-defence-industrial obligations.
Third-party links
The Site may link to third-party websites or resources (including standards bodies, regulators, and industry associations) for convenience. NPL does not endorse, control, or accept responsibility for the content, availability, security, or privacy practices of any third-party site. Your use of any linked site is at your own risk and subject to that site's own terms.
Disclaimer & limitation of liability
The Site and its Content are provided "as is" and "as available". To the maximum extent permitted by law, NPL makes no warranty, express, implied, or statutory, that the Site will be uninterrupted, error-free, secure, or fit for any particular purpose, or that Content is accurate, complete, current, or suitable for any specific application.
Technical descriptions, datasheets, and specifications published on the Site are indicative. Actual product specification is set out in the contract and the certificate of analysis (COA) supplied with each lot. You must not rely on Site Content for design, qualification, or safety-of-life decisions.
To the maximum extent permitted by law, NPL excludes all liability, whether in contract, tort (including negligence), under statute, or otherwise, for any loss or damage arising out of or in connection with your use of the Site, including loss of profit, loss of revenue, loss of data, loss of opportunity, business interruption, and any indirect or consequential loss.
Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth) or any equivalent state or territory legislation that cannot lawfully be excluded.
Indemnity
You indemnify NPL, its officers, employees, and contractors against all claims, losses, damages, costs, and expenses (including reasonable legal costs) arising out of or in connection with:
- Your breach of these Terms;
- Your breach of any applicable law, including export-control, sanctions, or work-health-and-safety law;
- Any unauthorised use of your Partner Portal credentials caused or contributed to by your act or omission;
- Any third-party claim arising from your use of the Site or Content.
This indemnity is reduced to the extent the relevant loss was caused or contributed to by NPL's wilful misconduct or its breach of these Terms.
Suspension & termination
NPL may suspend, restrict, or terminate your access to the Site or the Partner Portal at any time, with or without notice, where:
- You breach, or NPL reasonably suspects you have breached, these Terms;
- Required for security, compliance, export-control, or sovereign-defence reasons;
- The organisation that authorised your access withdraws that authorisation;
- NPL discontinues the Site or any feature.
Clauses that by their nature should survive termination, including §§ 7 (IP), 10 (Liability), 11 (Indemnity), and 13 (Governing law), survive termination of these Terms.
Governing law & jurisdiction
These Terms are governed by the laws in force in the State of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from those courts in respect of any dispute arising under or in connection with these Terms or the Site.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Changes to these terms
NPL may update these Terms from time to time. The current revision is identified in the document metadata above (LG-TOU · Revision A · Effective 01 Jan 2026). Material changes will be flagged on this page for at least 30 days before they take effect. Non-material changes (e.g. typographical corrections, link updates) take effect on publication.
